Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Budgetify Technologies Limited (“Budgetify AI”, “we”, “us”) and govern your use of our websites, apps and services (the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy. If you do not agree, please do not use the Service.

Budgetify AI is a technology platform that helps you understand, manage, protect and grow your money. To be clear about what we are not:

• We are not a bank and we do not take deposits or hold your funds in our own name.
• We are not a financial adviser and we do not provide personalised investment, legal or tax advice.
• We are not a fund manager and we do not choose investments for you.

Regulated activities such as custody of funds, payments and investment products are carried out by licensed partners, as described below.

You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is currently offered in Nigeria, and some features may not be available everywhere. You are responsible for using the Service in line with the laws that apply to you.

You agree to give accurate information, keep your login details secure, and take responsibility for activity on your account. Tell us promptly at hello@budgetifyai.com if you suspect any unauthorised access. We may require identity verification for certain features.

When you connect a financial account, you authorise Budgetify AI to access it on a read-only basis through a licensed provider, so we can show you your transactions and give you insights. Read-only access does not permit us to move your money.

You confirm that you own or are authorised to connect any account you link, and you can disconnect an account at any time.

Moving money is always optional and requires your separate, explicit permission. Where you enable it, you authorise Budgetify AI to help set money aside on your behalf according to the settings you choose.

• You can choose full automation or manual approval, and you can change or withdraw this permission at any time.
• Automated actions are designed to be explainable and, where possible, reversible within a clearly communicated window.
• You remain responsible for maintaining sufficient funds and for the account details you provide.

Where money is protected or grown on your behalf, it is held by licensed, regulated financial partners, not by Budgetify AI. We coordinate the experience and show you your balance and any growth.

• Your principal remains yours, and you can request to withdraw it, subject to any processing times and the partner’s terms.
• Returns are not guaranteed. The value of any growth depends on the partner product and prevailing rates, and may change over time.
• The handling of funds is also subject to the terms of the relevant licensed partner, which we will make available where applicable.

The core protection is free. We also offer optional paid plans that add capacity and convenience. Prices and what each plan includes are shown on our Pricing page and may change with notice.

Where Budgetify AI helps you grow money through licensed partners, we may earn a share of the interest or returns generated, disclosed as a platform fee. You always keep your principal and your share of any growth. We do not charge hidden fees, and we do not sell your data.

The Service relies on third parties such as bank-data providers, payment processors, and licensed financial and investment partners. Your use of those services may also be subject to their terms. We are not responsible for the acts or omissions of third parties, but we choose our partners carefully and require them to meet appropriate standards.

Insights, forecasts, suggestions and reports are provided for general information to help you manage your money. They are not financial, investment, legal or tax advice, and they do not account for every aspect of your circumstances. You are responsible for your own financial decisions, and you may wish to seek independent advice.

You agree to use the Service only for lawful purposes and in line with our Acceptable Use Policy. Misusing the Service may result in suspension or termination of your account.

The Service, including its software, content, design and trademarks, is owned by Budgetify AI or its licensors and is protected by law. We grant you a limited, personal, non-transferable licence to use the Service. You keep ownership of the content and data you provide, and you grant us the permissions we need to operate the Service for you.

We work to keep the Service available and reliable, but we may modify, suspend or discontinue parts of it, and maintenance or outages may occur. We will give reasonable notice of significant changes where we can.

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties such as merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that insights and forecasts will be accurate.

To the maximum extent permitted by law, Budgetify AI will not be liable for indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill. Nothing in these Terms limits liability that cannot be limited by law. Where liability is permitted to be limited, our total liability is limited to the amount you paid us, if any, in the twelve months before the event giving rise to the claim.

You agree to indemnify Budgetify AI against claims, losses and reasonable costs arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

You can stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. Where money is held with a partner, you will be able to withdraw it in line with the applicable terms before closure takes full effect.

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Continuing to use the Service after an update means you accept the revised Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria. We would always prefer to resolve any concern with you directly, so please contact us first. Any dispute that cannot be resolved informally will be subject to the appropriate courts of Nigeria.
